Instead of using a simple test of constitutionality on the E.O., a federal judge struck down the order on the grounds that there was no "rational basis" for it. But my question for this judge is this: who is in a better position to decide the "rationality" of an executive action—a judge, or the president who gets national security briefings? I joined Brian Kilmeade on Fox & Friends live from the Super Bowl stadium in Houston this morning to discuss: If the judiciary is supposed to be a check on executive overreach, the executive branch is also supposed to be a check on judicial overreach.
